The Rockstar Service - Terms of Use & Membership Agreement

This document outlines the terms and conditions for both Consumers/Users accessing our local directory and Business Owners subscribing to our media services and network. By accessing rockstarking.com, you agree to these terms.

PART I: CONSUMER & VISITOR TERMS

(For Locals and General Users searching for events, deals, and businesses)

1. Legal Disclaimer & Nature of Platform

The Rockstar Service, doing business as Rockstar King™, is a local media network and directory platform connecting Colorado residents with independent local businesses ("Members").

  • Not a Service Provider: We do not prepare food, host the events, or perform the services listed on this site.

  • Coupons & Deals: Any discounts, coupons, or deals promoted via our videos or directory are fulfilled entirely by the individual business. The Rockstar Service is not responsible if a business modifies, refuses, or discontinues a promotion.

2. Independent Businesses (Liability Release)

All services, products, and experiences are provided solely by the independent business listed on the profile.

  • Contracting & Transactions: Any transaction or agreement entered into is strictly between the Consumer and the Business. The Rockstar Service is not a party to these transactions and is not liable for disputes, damages, injury, or losses arising from visiting these local establishments.

PART II: BUSINESS MEMBERSHIP AGREEMENT

(For Local Businesses, Restaurants, and Brands subscribing to our services)

3. Scope of Services & Membership

Rockstar King Media (a service of The Rockstar Service) provides a Growth Infrastructure Platform for local businesses. The specific components of your membership are determined by your selected tier (e.g., Directory Listing, UGC Video Creation, Social Media Management, Ad Management).

  • Media Creation: We provide on-site video shoots (User Generated Content) and editing.

  • Verified Authority Profile: Hosting and maintenance of your digital business profile on our directory.

4. Payment, Fees & Refund Policy

  • A. Membership Fees: Membership fees are billed on a month-to-month basis. Payments are processed automatically on the same day each month using the payment method on file.

  • B. Setup/Shoot Fees (Non-Refundable): You understand that initial setup fees or one-off video shoot fees cover the immediate labor, travel, and editing required to build your custom content. This fee is strictly non-refundable once processing or filming begins, as the work is performed immediately.

  • C. No Refunds Policy: ALL SALES ARE FINAL. There are NO REFUNDS on any payments made, including but not limited to Setup Fees, Monthly Membership Fees, Ad Spend, or Add-On purchases. By purchasing, you acknowledge that the nature of the service (digital setup, custom profiles, video editing, and marketing infrastructure) involves immediate labor and costs incurred by the Company.

  • D. Rate Lock Guarantee: If you subscribed under a promotional price, this rate is locked for as long as your subscription remains active and in good standing. If you cancel and re-subscribe later, you will be subject to current market pricing.

5. Cancellation & Termination

  • A. Cancellation Policy: You may cancel your month-to-month membership at any time. To cancel, you must contact your Account Manager directly or submit a request via our support email.

  • B. Consequence of Cancellation: Upon cancellation or failure of payment, your access to the Platform is revoked immediately. This includes the removal of your business from the directory and the cessation of any ongoing social media management or ad campaigns.

6. Add-On Services (Ads & Leads)

If your tier includes or if you purchase optional Ad Management packages:

  • Ad Spend: Funds allocated for ad spend (Facebook/Instagram/TikTok) are non-refundable once the campaign has launched, as this money is paid directly to the ad networks.

  • Lead/Traffic Volume: While we strive to hit target traffic and view volumes, specific results may vary based on market conditions and seasonality. We guarantee the work (creating ads/managing campaigns), not a specific number of sales.

7. Intellectual Property

  • Member Content: You retain ownership of your business logo, brand images, and customer data.

  • Platform & Media Assets: The Rockstar Service retains ownership of the underlying directory code, profile designs, ad creatives, and raw/edited video assets created by the Company. You are granted a license to use these video assets only while your membership is active, unless otherwise agreed upon in writing.

8. Third-Party Affiliation & Earnings Disclaimer

  • Not Facebook/Google/TikTok: This site is not a part of the Google, YouTube, Bing, TikTok, or Facebook website; Google Inc., Microsoft Inc., ByteDance, or Meta Inc. Additionally, this site is NOT endorsed by Google, YouTube, Bing, TikTok, or Facebook in any way.

  • Earnings Disclaimer: We don't believe in get-rich-quick programs. We believe in hard work, adding value, and serving others. As stated by law, we can not and do not make any guarantees about your own ability to get results or earn any money with our ideas, information, programs, or strategies. Nothing on this page, any of our websites, or any of our content is a promise or guarantee of results or future earnings.

PART III: GENERAL LEGAL TERMS

9. Limitation of Liability & Indemnification

  • A. Limitation of Liability: In no event shall The Rockstar Service, its directors, employees, or agents be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits or lost revenue. Our total liability for any claim shall not exceed the total amount paid by the Member in the preceding one (1) month.

  • B. Indemnification: You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees, arising out of your use of the Site or services.

10. Consent to Contact (TCPA)

By entering your information and submitting forms on our Site, you provide your electronic signature and express written consent for The Rockstar Service to contact you for marketing and fulfillment purposes. You agree to receive communications via telephone calls, SMS/Text messages, and emails.

11. Governing Law

This agreement shall be governed by the laws of the State of Colorado. Any disputes arising from this agreement shall be resolved through binding arbitration in Larimer County, Colorado.
